# Terms of Use

## Acceptance of Terms

By accessing and using AudioMultiCut, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

## Service Description

AudioMultiCut is a free web application that allows users to:

- • Cut multiple segments from audio files
- • Automatically detect segments in audio content
- • Optionally detect spoken words and rough word timings with a local browser-based Whisper AI model on supported devices
- • Export processed audio segments in various formats
- • Process audio files locally in their web browser
- • Download the native app for iPhone and iPad from the App Store where available

## User Responsibilities

### Content Ownership and Rights

- • You must own or have proper licenses for all audio files you process
- • You are solely responsible for ensuring you have the right to use, modify, and distribute your audio content
- • You must not upload copyrighted material without proper authorization
- • You must not use the service for any illegal or unauthorized purposes

### Prohibited Uses

- • Processing copyrighted audio without proper licenses
- • Creating content that violates any laws or regulations
- • Attempting to reverse engineer or misuse the service
- • Using the service to harm, harass, or intimidate others
- • Automated or bulk processing that could impact service performance

## iOS App

- • The official native app is available from the App Store for supported Apple devices and regions
- • App Store purchases, refunds, and availability are handled through Apple's systems
- • The app may use free, subscription, credit-based, or separately paid features
- • If you bought the iOS app before it moved to a free plan, your purchase keeps the features it included while those features remain available; it does not guarantee future features, separate paid offerings, subscriptions, credits, or continued app availability
- • Regional availability may be limited by App Store restrictions

## Service Limitations

### Browser-Based Processing

- • Processing capabilities depend on your device's performance
- • Large audio files may cause browser slowdowns or crashes
- • Service functionality depends on browser compatibility
- • Local AI word detection requires a more capable device and compatible browser than normal waveform editing
- • We recommend using modern browsers for best performance

- • Service is provided "as is" without warranties
- • We do not guarantee continuous, uninterrupted access
- • Features may be modified or discontinued without notice
- • Browser compatibility may vary across different platforms

## Local AI Transcription

- • Optional word detection and transcription features may use a third-party open-source Whisper speech recognition model, currently [Xenova/whisper-tiny.en](https://huggingface.co/Xenova/whisper-tiny.en), through browser-based AI tooling
- • The model runs locally in your browser after the required model files are downloaded and cached by your browser
- • Transcripts, word timings, and suggested speech-based cuts may be inaccurate, incomplete, slow, interrupted, or unavailable on some devices, operating systems, browsers, browser versions, and files
- • The feature uses a small on-device/browser model and can make more mistakes than larger cloud transcription systems
- • The model and related third-party software are provided under their own open-source licenses and without warranties from their authors or from AudioMultiCut

## Privacy and Data

- • All audio processing happens locally in your browser
- • Your audio files are never uploaded to our servers
- • If you use local AI transcription, your browser may download and cache third-party model files, and may locally cache detected words and word timings for the file, but the transcription work is intended to run locally in your browser
- • We collect usage analytics as described in our [Privacy Policy](https://audiomulticut.com/privacy)
- • If you previously submitted the iOS beta signup form, you allowed us to use your email and optional use-case details to manage beta access, send beta updates, ask for feedback, provide support, share limited iOS app launch updates, and link your email with your beta account, TestFlight tester status, and site/app analytics identifiers for beta operations and product improvement
- • To be removed from the beta list or stop beta communications, use the unsubscribe link in a beta email, reply to any beta email, or contact us through the [feedback form](https://audiomulticut.com/feedback) and ask for removal
- • If you submit the product updates subscription form, you allow us to use your email to send product updates, app launch news, release notes, and occasional marketing emails from AudioMultiCut, including through Resend, Substack, or another configured email provider
- • To stop product updates or marketing emails, use the unsubscribe link in an update email, reply to the email, or contact us through the [feedback form](https://audiomulticut.com/feedback)
- • You retain full ownership and control of your audio content

### Analytics and Tracking

By using AudioMultiCut, you consent to the collection of anonymous analytics data through:

- • Google Analytics and Google Ads for usage tracking and advertising optimization
- • Meta Pixel for ad-attributed page view measurement and advertising optimization
- • Mixpanel for feature usage analysis and product improvement
- • Hotjar for user experience insights and interface optimization
- • Microsoft Clarity for user experience insights and interface optimization
- • Vercel Analytics for performance monitoring and web vitals tracking

Analytics data is intended to be anonymous and does not include your audio content, transcript text, or personal information.

## Intellectual Property

- • AudioMultiCut interface and code remain our intellectual property
- • You retain all rights to your original audio content
- • Processed audio segments remain your property
- • You may not copy, modify, or redistribute our application code

## Disclaimers and Limitations

### No Warranty

AudioMultiCut is provided "AS IS" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

- • We are not responsible for any data loss or corruption
- • We are not liable for any damages arising from service use
- • Users assume all risks associated with audio processing
- • We do not guarantee the accuracy or quality of processed audio
- • We do not guarantee the accuracy, availability, completeness, or timing quality of local AI transcripts, word detection, or speech-based cut suggestions

## Copyright Compliance

### Important Notice

- • Respect copyright laws and intellectual property rights
- • Only process audio content you own or have permission to use
- • Be aware of fair use limitations and licensing requirements
- • Consider seeking legal advice for commercial use cases

## Service Availability

- • We strive to maintain service availability but cannot guarantee 100% uptime
- • Maintenance, updates, or technical issues may cause temporary interruptions
- • We reserve the right to modify or discontinue the service at any time
- • No advance notice is required for service changes or interruptions

## Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from the use of this service shall be resolved through appropriate legal channels.

## Changes to Terms
